By purchasing from atëmier, you confirm whether you are acting:a) As a business, professional, or entrepreneur (B2B), or
b) As a private individual acting outside your trade or profession (consumer).Different rights and obligations may apply depending on your status.

4. Consulting Services

4.1 Service Agreements

Consulting services are provided according to the scope, deliverables, and fees agreed in writing (including proposals, contracts, or invoices). Such documents form part of these Terms.

4.2 Fees and Payment

All prices are stated in EUR and are exclusive of VAT or other applicable taxes unless expressly stated otherwise. VAT will be applied in accordance with applicable Spanish and EU tax regulations. Unless otherwise agreed: Payment is due in advance. Work begins only upon receipt of payment or agreed deposit. Deposits are non-refundable once work has commenced. atëmier reserves the right to suspend services in case of non-payment.

4.3 Client Responsibilities

The Client agrees to provide accurate and timely information necessary for service delivery. Delays caused by the Client may result in timeline adjustments.

5. Digital Products

5.1 License

Upon purchase, you are granted a non-exclusive, non-transferable, non-sublicensable license to use the digital product for your internal business or personal use only.

5.2 Restrictions

You may not:Resell, redistribute, or sublicense the productShare login access or filesModify and sell derivative versionsUse the product for unlawful purposesAll intellectual property rights remain the exclusive property of atëmier.

5.3 Access

Digital products are delivered electronically. Access may be revoked if these Terms are violated. Delivery is deemed complete once access to the digital product has been provided.

6. Right of Withdrawal (EU Consumers Only)

If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within fourteen (14) days without giving any reason.The withdrawal period expires fourteen (14) days from the date of contract conclusion.To exercise your right, you must notify us at:

6.1 Digital Content Exception

For digital products not supplied on a tangible medium:By completing your purchase, you expressly consent to immediate access to the digital product and acknowledge that you lose your right of withdrawal once performance has begun.(This consent must be actively given at checkout.)

6.2 Services

If you request that consulting services begin during the withdrawal period, you agree to pay for services performed up to the date of withdrawal.

7. Refund Policy

Digital products are non-refundable once accessed or downloaded, except where mandatory consumer law applies.Consulting fees are non-refundable once services have commenced.Nothing in this section affects mandatory rights under applicable consumer protection laws.

8. Intellectual Property

All website content, branding, materials, frameworks, methodologies, and digital products are protected by intellectual property laws.

8.1 Consulting Deliverables

Unless otherwise agreed in writing:Final deliverables are licensed to the Client for agreed use.atëmier retains ownership of underlying methodologies, frameworks, and know-how.atëmier may display non-confidential work in its portfolio unless agreed otherwise.

9. Limitation of Liability

To the maximum extent permitted by applicable law:atëmier shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, revenue, or business opportunities.Total liability arising from any contract shall not exceed the amount paid for the relevant service or product.Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under Spanish law.

9.1 Force Majeure

atëmier shall not be liable for any failure or delay in performance resulting from causes beyond reasonable control, including but not limited to acts of God, natural disasters, governmental actions, internet outages, technical failures, labor disputes, or other unforeseen events.
